Drafting a Will.

At Cumiskey Solicitors we are experienced in drafting wills. Our goal is to ensure that that the process is as straightforward, stress-free and efficient as possible. If your estate is straightforward and you don't have assets such as shares or foreign property, we can proceed to draft a Will for your approval.

If your estate is more complex and requires us to consider estate planning, trusts, multiple legacies and tax implications for your beneficiaries, we will need to take further instructions and more work will be involved. Grants of Probate.

Probate is the legal process by which a person gains the authority to deal with a deceased person's estate. Dealing with the the difficult circumstances when somebody passes away is stressful and emotionally exhausting. Powers of Attorney & Wardship.

If a person becomes mentally incapacitated due to illness or disability, their assets and property are usually frozen and can't be accessed unless someone has power of attorney to deal with them.

An Enduring Power of Attorney (EPA) allows a person (the Donor) to set up a legal device when they are in good mental health, to allow a specially appointed person (the Attorney) to take actions on the donor's behalf, to make "personal care decisions" and / or financial and property decisions, once they are no longer mentally capable of making decisions themselves. Please contact us at Cumiskey Solicitors to make an appointment to discuss.


 

Probate Disputes & Litigation.

Disputes can arise in connection with wills or Grants of Probate, and unfortunately these can  lead to claims against the estate.
